TERMS & CONDITIONS OF SERVICE

(Perth, Western Australia)

These Terms and Conditions (“Terms”) apply to all quotations, bookings, and services provided by Diamond Cut Coatings (“we”, “us”, “our”). By accepting a quotation, paying a deposit, allowing work to commence, or otherwise engaging our services, you (“Client”) are deemed to have read, understood, and agreed to these Terms.

1. Quotations & Formation of Contract

1.1 All quotations (“Quote”) are valid for 30 days, unless otherwise stated.
1.2 A booking is confirmed only when the Client accepts the Quote in writing, or by paying the required deposit.
1.3 Prices are based on information supplied by the Client. Undisclosed issues (including damaged substrate, moisture, pre-existing coatings, contamination, poor access, or structural movement) may require additional work, charged at extra cost.
1.4 The Scope of Services is strictly limited to what is outlined in the Quote. Any variation must be agreed in writing and may affect cost and timeframes.

2. Client Responsibilities, Site Access & Pre-Work Conditions

2.1 The Client must ensure the Site is safe, accessible, clean, dry, and free from obstructions before our arrival.
2.2 The Client must provide clear access, electricity, lighting, water, ventilation, and parking.
2.3 The Client must disclose all Site conditions that may affect the work, including moisture issues, prior coatings, contamination, cracks, chemical use, drainage problems, or structural defects.
2.4 Diamond Cut Coatings is not responsible for delays or damage caused by pre-existing substrate issues, structural movement, or moisture ingress.
2.5 If the Site is not ready, safe, or accessible, additional fees may apply for delays, re-attendance, or additional preparation.

3. Performance of Services

3.1 We will provide epoxy flooring services with due care and skill and in accordance with industry standards in Western Australia.
3.2 Estimated timeframes are indicative only. Curing conditions, temperature, humidity, product behaviour, and environmental factors may impact completion.
3.3 The Client must not interfere with work areas, equipment, or materials once works commence.

3A. Strict Access Restrictions During Works & Curing

3A.1 Once work begins, the entire work area is strictly out of bounds to the Client, household members, pets, trades, or visitors until Diamond Cut Coatings gives written clearance.
3A.2 During application and curing, the Client must NOT:

  • open windows, doors, or create drafts;

  • use fans, air-conditioning, or heating unless authorised;

  • allow dust, debris, insects, or contamination into the area;

  • walk on, touch, place items on, or otherwise interfere with the floor;

  • allow other trades onsite near the coated area.

3A.3 Any contamination, defects, or damage caused by failure to follow instructions (including draft marks, bubbles, debris, footprints, liquids, or premature access) will require repair at the Client’s full expense.
3A.4 Diamond Cut Coatings accepts no liability for defects caused by interference, accidental damage, unauthorised access, or environmental disturbance during curing.

4. Post-Completion Conditions

4.1 The Client must strictly follow all post-completion and care instructions provided.
4.2 The Client must not:

  • walk on the floor before the specified curing time;

  • wet clean the floor until permitted;

  • place furniture or heavy objects on the floor prematurely;

  • expose the floor to chemicals, spills, or impact during the curing period.

4.3 Normal curing times may vary due to environmental conditions outside our control.
4.4 Damage from misuse, impact, chemical exposure, or failure to follow after-care instructions is the Client’s responsibility.

5. Risks of Non-Compliance

If the Client fails to meet responsibilities before, during, or after works, the following may occur at the Client’s risk and expense:

  • bubbling, peeling, or poor adhesion;

  • colour change, blush, or discolouration;

  • cracks, delamination, or lifting;

  • moisture-related failure;

  • dust, insects, or contamination set into coating;

  • extended curing time or complete coating failure;

  • re-sanding, re-grinding, or full re-application costs.

6. 10-Year Warranty

6.1 Diamond Cut Coatings provides a 10-year workmanship and product warranty against defects arising solely from our workmanship or materials we supplied, under normal residential use.
6.2 This warranty covers:

  • adhesion failure caused by our workmanship;

  • product failure arising from our installation.

6.3 This warranty does not cover:

  • substrate issues (rising damp, cracks, structural movement, vapour transmission);

  • damage from misuse, neglect, heat, spills, pets, chemicals, impact, abrasion, or heavy loads;

  • aesthetic variations, texture irregularities, or minor colour inconsistencies;

  • contamination or interference during curing;

  • work altered or repaired by others without our consent.

6.4 Warranty claims must be submitted in writing with proof of purchase and photos.
6.5 Failure to comply with any Site, curing, access, or after-care requirement may void the warranty to the extent permitted by law.
6.6 This warranty operates in addition to the Client’s rights under the Australian Consumer Law (ACL).

7. Liability & ACL Compliance

7.1 To the maximum extent permitted by law, we exclude all liability for loss, damage, costs, or consequential loss after completion of works.
7.2 Nothing in these Terms excludes consumer guarantees that cannot be excluded under the ACL.
7.3 Where permitted, our liability is limited to (at our discretion):

  • re-supplying the services; or

  • paying the cost of re-supplying the services.

7.4 We are not liable for:

  • defects caused by Client interference, non-disclosure, or failure to follow instructions;

  • substrate defects, moisture, structural movement, or pre-existing conditions;

  • aesthetic variation, wear and tear, or environmental effects;

  • contamination beyond our control;

  • third-party trades, contractors, or services.

7A. Epoxy Resin Characteristics, Expected Finish & Product Behaviour

7A.1 Epoxy resin flooring is a hand-applied, chemical-reactive product. As such, the final finish may vary depending on substrate condition, environmental factors, moisture, temperature, and curing conditions.
7A.2 The Client acknowledges and accepts that due to the nature of epoxy resin:

  • minor surface variations may occur;

  • slight roller or application marks may be visible upon close inspection;

  • colour variation may occur between batches or due to substrate porosity;

  • gloss levels may vary from expectations;

  • small air bubbles or pinholes may appear, especially with porous substrates;

  • insects, dust, lint, and airborne contamination may land in the coating during curing;

  • humidity may cause amine blush (whitening or dull spots);

  • moisture in the slab can cause cloudy patches, bubbles, or delamination;

  • temperature changes may affect curing time, texture, and flow;

  • metallic or decorative epoxy effects cannot be precisely replicated from samples;

  • hand-crafted marbling or swirling is not identical to reference images;

  • previous coatings or unknown contaminants may affect finish outcome;

  • hairline cracks may reappear over time due to substrate movement.

7A.3 While we take all professional measures to achieve the best possible result, Diamond Cut Coatings does notguarantee:

  • a perfectly “factory” or machine-made finish;

  • a flawless surface free of minor aesthetic inconsistencies;

  • an outcome identical to samples, photos, or showroom examples.

7A.4 The Client acknowledges that these possible outcomes are normal characteristics of epoxy resin systems and do not constitute defects, warranty claims, or grounds for refusal of payment.

8. Subcontractors

8.1 Diamond Cut Coatings may refer independent subcontractors directly to the Client. Such subcontractors:

  • are independent businesses,

  • are not our employees or agents, and

  • hold their own insurance and terms.

8.2 We are not liable for any work performed by subcontractors engaged directly by the Client.
8.3 Where subcontractors are engaged by us under the Quote, we remain responsible only for the portion of work performed under our direct supervision.

9. Payment Terms

9.1 A deposit (as advised) is required to secure the booking.
9.2 The balance is due on completion unless otherwise agreed in writing.
9.3 Late payments may incur interest, debt recovery costs, and administrative fees.
9.4 Materials may be ordered in advance; cancellations after materials are ordered may incur fees.

10. Cancellations & Rescheduling

10.1 Cancellations within 14 days of the start date result in forfeiture of the deposit.
10.2 Rescheduling is subject to availability.
10.3 If the Client delays the project, additional mobilisation or waiting fees may apply.

11. Force Majeure

We are not liable for delays or non-performance caused by events outside our reasonable control, including weather, supply issues, illness, or labour disruptions.

12. Governing Law

These Terms are governed by the laws of Western Australia. Any disputes shall be heard in the courts of Western Australia.

Acknowledgement

By booking with Diamond Cut Coatings, the Client acknowledges they have read, understood, and agreed to these Terms & Conditions.
