TERMS & CONDITIONS OF SERVICE

These Terms and Conditions (“Terms”) apply to all bookings, quotations, and services provided by Diamond Cut Coatings (“we”, “us”, “our”). By making a booking or proceeding with our services, you (“the Client”) agree to these Terms.

1. Quotations & Bookings

1.1 All quotations are valid for 30 days from the date of issue unless otherwise stated.
1.2 A booking is confirmed only upon acceptance of the quotation and payment of any required deposit.
1.3 Prices are based on information provided by the Client. Any variations (e.g., undisclosed floor conditions, additional preparation work, or access issues) may incur additional costs.

2. Site Preparation & Client Responsibilities

2.1 The Client is responsible for ensuring the work area is clear, clean, and free of obstructions prior to commencement.
2.2 The Client must ensure safe access, electricity, water, and adequate ventilation are available.
2.3 Diamond Cut Coatings is not responsible for damage to property or delays caused by pre-existing conditions (including cracks, moisture, or structural issues).

3. Services & Workmanship

3.1 We will carry out epoxy resin flooring services with due care, skill, and in accordance with industry standards.
3.2 Completion times are estimates only. Weather, curing, and site conditions may extend the timeframe.

3A. Access Restrictions During Works

3A.1 Once work has commenced, the work area must remain strictly out of bounds to the Client, household members, pets, or any third parties until Diamond Cut Coatings confirms the surface is ready for access.
3A.2 Any damage, defects, or delays caused by unauthorised access (including walking on, placing items on, or spilling liquids on the surface before curing is complete) will be repaired at the Client’s expense.
3A.3 Diamond Cut Coatings is not liable for any defects caused by early access or interference during the curing process.

4. Warranty

4.1 Diamond Cut Coatings provides a 10-Year Warranty from the date of completion for workmanship and product integrity under normal residential use.
4.2 The Warranty covers:

• Adhesion of epoxy coating to prepared substrate.

• Normal wear and tear consistent with residential use.

  4.3 The Warranty does not cover:

• Damage caused by misuse, neglect, impact, abrasion, heat, water ingress, chemicals, or structural movement.

• Substrate issues (e.g., rising damp, cracks in concrete, shifting foundations).

• Work altered or repaired by third parties without our written consent.
  4.4 Warranty claims must be made in writing within a reasonable time of the issue arising and accompanied by proof of purchase.

5. Liability

5.1 To the maximum extent permitted by law, Diamond Cut Coatings excludes all liability for loss, damage, or costs (including indirect or consequential loss) arising after the work is completed.
5.2 Our liability is limited, at our option, to either:

• Re-supplying the services, or

• Paying the cost of having the services re-supplied.
  5.3 Nothing in these Terms excludes liability that cannot be excluded under the Australian Consumer Law (ACL).

6. Payment

6.1 A deposit (as advised) must be paid prior to commencement.
6.2 The balance is payable on completion of works, unless otherwise agreed in writing.
6.3 Late payments may attract interest and recovery costs.

7. Cancellations & Rescheduling

7.1 Cancellations made less than 14 days before the scheduled start date will result in forfeiture of the deposit.
7.2 Rescheduling will be accommodated where possible but is subject to availability.

8. Force Majeure

We are not liable for delays or failure to perform due to events beyond our reasonable control, including but not limited to extreme weather, supply shortages, or labour disruptions.

9. Governing Law

These Terms are governed by the laws of Western Australia, and any disputes shall be subject to the jurisdiction of the courts of Western Australia.

By booking with Diamond Cut Coatings, the Client acknowledges that they have read, understood, and agree to these Terms and Conditions.
